The US Trademarks will die when the mail from the US Patent Office returns unopened.  There's an annual fee associated with US Trademarks.  It'll be marked Dead about 8 months after they miss the fee payment, then it's anybodies for the taking.  

There legal paperwork, the whole thing can be done for US $325 if you don't hire a lawyer, but if your application hits the desk of one of the Trademark people before Amiga's trademarks are declared dead you'll have to start over....
