On a lighter note: It's quite hilarious that some have been happy to shoot down MorphOS for just rumours of being based on some 3.1 source code (which it is not, obviosly. Some belgian guy appears to have some serious obsession). When it appears OS4 could really be using the IP illegally... it's completely different story, in fact it will be announced as a positive fact. Talk about double standards.

Hmm, true, Hyperion can own OS4 only in case of Amiga Inc. bankruptcy, if I recall correctly.

Only if it was legal, and at first I thought it could be, but now I remembered what's inside Hyperion's contract. On a related note, YellowTab has done an IP theft with Zeta, and they have been lucky Palm hasn't sued them while Zeta was still available commercially.

Which isn't legal under US law and the contract agreed any legal proceeding would be covered under US (orginal contract was under WA and artic was under CA) law.

Under US law, if a contract contains illegal stipulations is the *entire* contract made invalid or just the illegal parts?

IANAL.  There is no hard yes/no, as far as I understand it.  Since that clause was never used, it's a "so what" catagory.  If it was something major, then it would give both parties options to void the contract and seek legal protection.  Today, it really does not matter since AI opted to terminate the contract by giving Hyperion due notice; which was called for in the contract.  :horse:

The companies involved may not have yet accepted this, but I think the OS4 "market" has boiled down to the point where piracy isn't an issue. The only people left who even think about OS4 are those who are more than anxious to pay money for it, and those who might have been interested years ago but now wouldn't run OS4 if you paid them to.

If AInc loses and they probably will since they went insolvent according to Bill's own court declarations on the past(the excuse given to not paying employees IIRC), all the future versions of classic AmigaOS are entitled to Hyperion.
That's according was the agreement AInc signed.

maybe somebody can just leak the whole os4 source code and end this insanity?
