Amiga Inc complained to eBay that the press kit was "Unauthorized copies include (but
are not limited to) backup, pirated, duplicated, or bootlegged copies." Pffft, idiots. eBay rolls for anyone. this was not bootleg, a copy or anything else. It was an press kit they freely gave out to members of the PRESS and companies. Oh well, like usual Amiga Inc is a day late and a dollar short as the auction was already closed and the item shipped days ago. Below is the full message.

I have a good idea why McBill complained to eBay, but it has nothing to do with me or any legality of me selling this. It has to do with the fear of someone with a judgement against them getting a hold of it. You can draw your own conclusions.. Oh well, I'm not angry or anyting, just having a laugh at AI's expense. :lol:
Someone has to state the obvious and that someone is me!

That's a neat trick. You can auction stuff for free by having someone report it as a copyright infringement after the auction is over.


In your auction you said your didn't sign an NDA so you thought maybe it would be bad if you had. Someone that had it to begin with probably did sign something about not passing it out to the public. You just ended up with it somehow. The original recipient selling it and you selling it are tantamount to the same thing. Or, it could be that they thought it was something that they legally had to come down on or risk losing their copyrights or something. One email to ebay is easier and cheaper than having to go to court to get back some IP you lost because you failed to protect it.

Good for you.  Not just this incident, but things like this really cause
me to regret ever supporting Amiga Inc.  I am still optimistic that OS4
will eventually gain some momentium, but Amiga Inc really needs to
step out of the way so that the real supporters of Amiga (from all the
camps) can continue forward.

I haven't laughed this hard since... Well... Fleecy was fluffing the AW.net crowd all those years ago about how everything was on schedule and ready to go.  

First, it was a Gateway/Amiga Inc document, secondly, it's plans from 7 years ago which -- one would hope to almighty God -- don't still apply.  They gave out dozens of copies of the same document to just about everyone who attended that show (I believe it was either Sacramento or one of the last ST Louis shows) with no NDA involved.  

I know that all of the Huntsville Mafia here ended up with a copy.  I just wish my copy had survived.  I'd have HAD to put it on e-bay as a moral imperative.

In the end, it's pathetic really that Amiga Inc can't seem to think of anything more productive to do with their time.  Maybe next they'll go after everyone on e-bay selling their legitimate copies of Amiga OS disks because they aren't being sold with the hardware.  (I do believe I have about 4 different AmigaOS disk sets lying about without hardware).

One more thing, if they are so concerned with their intellectual property,
they should really step up pressure to end the sales of pirated software
that has been floating around on ebay.

didn't Amiga Inc have this stuff auctioned off in the FIRST PLACE? NOW, after they applied the money to their debts or whatever, they consider the stuff *THEY* auctioned off, CONTRABAND???

I would presume they may be afraid of very much that, though I cannot fathom how a Gateway Amiga statement might have affected the current company's plans or goals.

They did, and I wouldn't be surprised if that's where it came from.  Like I said, kinda pathetic.

Haha!  That is quite humourous.  And here I thought they might actually be doing a service and going after the people selling the questionable "pre-installed" HDs and the clearly pirate game DVDs....  No... Of course not...  It is AI, after all.  :-P
