Amiga Inc complained to eBay that the press kit was "Unauthorized copies include (but
are not limited to) backup, pirated, duplicated, or bootlegged copies." Pffft, idiots. eBay rolls for anyone. this was not bootleg, a copy or anything else. It was an press kit they freely gave out to members of the PRESS and companies. Oh well, like usual Amiga Inc is a day late and a dollar short as the auction was already closed and the item shipped days ago. Below is the full message.

Dear redrumloa,

Thank you for your recent auction-style listing on eBay. Unfortunately, we
removed the following item(s):

8799698954 - Amiga Inc press kit 1999 OS4.0 roadmap OS4 pre Amigaone

because Amiga Inc. reported it to us for violating their intellectual property
rights.  When eBay is notified by a rights owner of an intellectual property
rights infringement, eBay must remove the item in order to meet certain legal
requirements.

The following information may help explain the reason for your listing(s)
removal:

eBay prohibits unauthorized copies of media (such as software, video games,
music, television programs, and photographs). Unauthorized copies include (but
are not limited to) backup, pirated, duplicated, or bootlegged copies. It is
both illegal and against eBay policy to sell unauthorized copies of copyrighted
media.

To review a tutorial pertaining to this policy, please visit the link below:

http://pages.ebay.com/help/tutorial/verotutorial/intro.html

Questions about the specific violation should be addressed to Amiga Inc. at the
following email address:  info@amiga.com

Your eBay fees for this item have been credited to your account. All bidders
on this item have been notified of its cancellation.

IMPORTANT NOTICE: Repeated violations of this or other eBay policies may
result in the suspension of your account.

eBay understands that it can be frustrating to have a listing removed. If you
have further questions, you can take the following steps:

- Take eBay's brief tutorial on Intellectual Property Policies and VeRO
- Read the ended listings FAQ at http://pages.ebay.com/help/confidence/vero-removed-listing.html
- Ask eBay a question using the link on the above help page

Thank you in advance for your cooperation.

Regards,
eBay Trust & Safety

I have a good idea why McBill complained to eBay, but it has nothing to do with me or any legality of me selling this. It has to do with the fear of someone with a judgement against them getting a hold of it. You can draw your own conclusions.. Oh well, I'm not angry or anyting, just having a laugh at AI's expense. :lol:

In your auction you said your didn't sign an NDA so you thought maybe it would be bad if you had. Someone that had it to begin with probably did sign something about not passing it out to the public. You just ended up with it somehow. The original recipient selling it and you selling it are tantamount to the same thing.

No, not at all. There would be no legal reason why i couldn't sell something that was freely given out to anyone attending a trade show. The only reason I added that line about no NDA to the auction, was a preemptive strike against any questions that might arise. Even if there was an NDA involved, which I find out now was not the case, it may have raised a moral issue in some peoples minds, but not a legal issue.

an idea: scan and upload them to amiga.org :-)

I didn't scan every page to upload for 2 reasons. One is completely personal, but the other is the high bidder should get some pleasure of viewing his unique winnings before the rest of the community. Maybe the high bidder will feel inclined to scan the whole thing and post it.

Anyhow, here's what I did scan. Do what you wish with it. I recommend anyone who wants these images to download them, as I won't be hosting them for much longer on my temporary image hosting.

I personally think that this auction was childish in the first place, as the only intention of it was to bash Amiga INC.

Eh? :inquisitive:

Umm, no.. That would be a stupid reason to start an auction. The reason to run an auction is to make $$$ MOOLAH $$$, and this auction suceeded perfectly. If you are talking about the tiny bit of off color humor in inject, I do that to almost every auction listing, especially retro stuff. My listing have have had descriptions like "This is a big pile of useless crap, I have no idea why someone would bid on it. It will be packed in a box with no packing material and dropped repeatedly before shipping. No, really! Don't expect anything but small pieces!". I do that to lower expectations, then the buyer is happy to see it's not quite that bad;-) This one specifically? Yeah I guess you can say the humor has an element of snipe at AI, but after all these years and all their B$, I won't cry for them.

That's odd, someone in Amsterdam spoofed me on Moob.

Moo Bunny

Nothing really bad said, but why spoof me? Hoping someone will troll it? :-?

@Plaz

Sorry for the slow response, I've been out of town. All we know is someone claiming to be Amiga Inc complained, probably from a @amiga.com email address. My eBay account should be ok, as I don't sell pirate items, period. It does tick me off though. :angry:

@Argo

I don't know if I can agree with you. It's probably not a popular view, but I think Buck should persue his right to damages. Putting aside all personal issues people have with Buck, as valid as they may be, Amiga Inc did not deliver DE(Which at the time *WAS* called OS4 as this flyer shows).

Let the egg throwing commence :egad:
