Of course it is. AmiInc owns all OS source up to 3.9. If that was handed over to Hyperion, I'm guessing licenses for other platforms wouldn't be far behind.

Do we know that, or have they just been served a gag order while legal proceding progress? I can think of several reasons they're running stealth at the moment. Doesn't mean they're gone for ever.
Besides, you have no hardware to run it on.
Pah-leeeze, there's a planet full of hardware to run it on. All it takes is a port. All that's needed for a port is permission from the IP holder. All we need is an IP holder open to the idea.
There is zero chance of them releasing it open source.
No argument there. Even as a corpse, the remains of the Amiga IP are worth $$$ and they're not going to give it away for free.
