Microsoft wins Java appeal

A US federal court has overturned a ruling which would have forced Microsoft to incorporate Sun Microsystems' Java technology into Windows.



The judgement blocked a ruling made by a lower court judge last December that ordered Microsoft to carry the rival software.

The Java technology enables programs to be run on all types of computers, whether they use Windows, Apple's operating system or any other operating system.

However, the judges did uphold the lower court ruling that Microsoft had broken a 2001 legal settlement between the two firms and had infringed on Sun's copyrights, and returned the case to the lower court for further proceedings.

M$ probably used their huge pile of cash reserves to buy off/bribe the judges.

As a Java advocate and certified Java programmer, I don't think it would be right to force MS to install the latest Java with thier "OS".  I do however believe they should be forced to either exclude Java entirely (which includes the MS version of Java) or include the latest SUN version of Java.  There are already several programs out there that require Java to be installed.  Java is not going to die off any time soon with the amount of market share that it has for such a unique product.

I agree with Kent.  Microsoft has every right to ship whatever software they choose with their OS, within license restrictions.  Forcing Microsoft to supply Java with their OS is pretty dumb, but forcing them not to have their own version of Java (MS Virtual Machine) is valid.

What next?  Will Apple get pissed because MS doesn't supply QuickTime with Windows?

This is all hot air, anyway.  If anyone gave a flying F*** about breaking up the Microsoft monopoly, they'd stop wasting their time with fluff like bundling IE and Java, and attack the core issues:  The bootloader and Microsoft's oh-so-secret "exclusivity" contracts.

Well, for example, if MS created a standard which claimed to be Quicktime compatible, gave away free movie players/editors for people to take up the new bastardised standard, then people find out it's not quite compatible, then Apple might have a right to get annoyed.
