« on: December 04, 2002, 04:11:24 AM »
Bernie discuses what went on behind the scenes, the impossibility of making Amithlon open source, and he also directly responds to questions proposed on ANN.

In my mind I want to keep thinking to myself that Amiga Inc. are not bad in this situation.  But I have to agree with a lot of the posts over at ANN that this looks real bad for them.  Their total lack of Legal action just looks bad.  They have postponed this for so long that H&P dont even take them seriously.

Also I think that if they let this go for to long they could lose their IP for lack of action....almost as if they abandoned it.  I hope I am wrong though.
Now that I think about it they are claiming that multiple parties are infringing on their IP.  And it looks as if all of those parties could care less due to their inability to act.  The only party that gave a damn was Berni and look where it got him.

HEY AMIGA INC.....WAKE UP.....START TAKING ACTION AND EXPLAIN YOUR SIDE OF THE SITUATION.

No normal human could see this now, with everything clarified and not feel, if but for just a moment, intense hatred towards H&P.

May they be ground into dust by AI's lawyers.

Well, then if I read it right. You might want to start a Bernie Defence Fund.

All i can suggested is that everyone boycot H&P and not buy any product distributed by them. I know this sounds harsh, but the only REAL way to make H&P realise what they have done is to hit them where it hurts, the purse strings.

You know, what with Bill Bucks recent post and the Bernie/H&P/Amiga things, for the first time, I can really see the whole thing tearing itself apart.

I think I need a break from all this.

Hmm.. H&P screw over P5 with the whole PowerPC fiasco (can we say ppc.library v powerpc.library).

Now they repeat the process with Bernie and Amiga Inc.

H&P are still in business, wheres P5? Bernie has given up.
Amiga Inc will go the same way if they're not careful!

H&P have always had a M$ mentality to the Amiga, and its about time Amiga Inc put them in their place!

Don't worry about Ainc loosing their IP due to lack of action.  In the current legal environment, that just doesn't happen.  In the courts, copyright/patent is like a holy artifact.  Unquestionable in its rightousness.  They could let it sit for 50 years, and then come back and all they would have to do is scream about the evil "pirates" and the courts would side with them.  The "We must sue to maintain our copyrights and patents" is a bogus line used by companies to justify the the masses why they are being assholes about IP they don't make money off anyways.

Mind you this dosn't make me side with H&P, I think Bernie got screwed.

I totaly agree with you Belial6.  No one really loses their IPs these days but it would be Amiga Inc's luck that they set a new precidence.

I have never realy delt with any of the major players(companies) in the amiga community as it stands now....been out of the amiga for about 5 years.  All I can say is that everything that I can gather over these past 2 or so years of casually checking out things is that H&P Suck.  I am amazed that H&P and a lot of other companies are still around.  They are not advancing the amiga they are stagnating it.  But someone out there must be purchasing products from them, there still here.  I personaly wont.

P.S. I still want to hear something from Amiga Inc, even if it is just to clarify the situtation.

This is only true if you have enough time, money, and lawyers to follow through with the action.  Amiga doesn't have any of the latter two, so their first one is running out, if it hasn't already.

Copyright "rights" go to the highest bidder.  If there's no bidders, it goes to the group with the largest 'stones' and the fewest morals.  Looks like that's H&P right now.  It sucks, but that's the way it goes.  We can only hope it creates enough of a public backlash that it shutters H&P, which is probably immenent, anyhow.
