While I would tend to agree, it doesn't say that.  It's just Hyperion's response to the complaint (38).

My question is, does the denial of injunction mean Hyperion can legally start selling OS 4.0?

Short answer, yes. However, it will do them no good if they loose the actual lawsuit, because Amiga Inc. will claim any profits as theirs.

As far as I can tell, anyone willingly touching OS4 at this point takes a big risk. There is no way telling how this lawsuit will end in year/two and *if* Hyperion loses (even partially) you'll end up in a lot of trouble if you'll been bundling your HW with this OS.

Imho, it's likely that this suit may well end up losing side paying considerable sums of money and at this point I doubt Hyperion could cough up the cash for any major compensations of illegal IP/trademark use.. (that is, if they lose)

The play to play actions of the court is irrelevant. All that matters is the final decision. The decision hasn't be made yet, anything before hand doesn't matter.

No company in their right mind would touch OS4 as it is now.  Unless Hyperion rolls over on this, which I doubt, AROS 4.x will be out before OS4 sees the light of day again. After the last appeal has been filed, regardless who wins the initial court case, OS4 will be rereleased many many years from now.

Still nothing that would indicate Hyperion winning anything, other than avoiding the preliminary injunction.

Lets check again in couple of years.
