Amiga Inc. may decline to change the agreement and pay early.  When changes are requested to an agreement/contract, both parties must agree and usually sign a revised agreement/contract.  The City of Kent could ask for verification that Amiga Inc. has the ability to pay the amount, such as asking for bank records to verify availability of funds, and Amiga Inc. could refuse again, as it was not part of the original agreement.

Bottom line is that the City of Kent has entered into an agreement with Amiga Inc. and now wants to change it, but must get Bill and Co. to agree to the changes.  As a former City employee, I can tell you from personal experience that City Council Persons are not always the sharpest tool in the shed!  :lol:

I'll be interested to see how Bill and Amiga Inc. react to all this negative press.

That will still make them look shady, as Bill McEwen pretty much accepted the change by replying what he did.
I think it is too late for them to save their face now, unless they do infact have the money to cough up. The amiga name will pretty much be worthless if this is the case, as it just has too much negative press already.

Remember though that Amiga feed the city supposedly the following snippets about the company to get into the agreement:

Amiga is the "third most-recognized brand in Europe".  When the Seattle Times asked for a reference on this Bill could not provide one, claiming he read it in some European magazine or something like that sometime back.

Amiga is "the world’s premier provider of multi-media enabling technologies".  I personally think to call this a stretch is being extremely extremely nice.

So, is this a fair representation to make in order to make this agreement happen?

I think Kent has a decent amount of leverage here.

another thing to think about is if ainc now do cough up the 2.5mill, and then loses the legal battle with hyperion and the brothers...

we will be eating :popcorn: for months if this happen...
