Usually they're stealing my artwork.  It's up to SimoAmi to take action in this case.  I just find it deplorable and wish that Amiga Inc would step in and do their job to protect their rights.

And I'm pretty sure MegaBall was shareware, at least after a while. Either way, you can't put it on something for sale.

is it really that bad? its just an image hes used. Not sealing software really.

Yes. This is copyright infrigiment. Basically he's reselling copyrighted material for profit without license.

Yes, yes it is. There are rules we and laws we must all play by. I've had plenty of ideas cut short by pesky things like legality, why should anyone else get a free ride?

Looks like the auction has been pulled.  I think a point that
hasn't been made clear here is why using the artwork is bad.
This guy used someone else's work without permission for financial
gain - to make his merchanise more appealing to potential customers.

I emailed him through the ebay function and asked him "Is this legal?" and he just replied with "yes". I'm glad they pulled it. Did you read the comments/testimonials section he put on there? It said something like "I bought this from you secveral weeks ago and I love it." The problem is, his feedback had nothing a few weeks ago and all his three feedbacks were from him buying stuff last year. sheesh!

straight after posting this i reported him purely on the grounds of theft of the Kickstarts

but as a graphic designer, I really hate people who steal artwork its one of those things that bugs me

Graphic designers get paid money to design graphics and this guy was stealing graphics for his case to sell. That's bad.
