Problem w/Paypal, chargeback, ebayer.

Long story short:

1. Sold A4000 on ebay
2. shipped late (8 days after pmt recieved)
3. Buyer claiming through paypal for non-reciept
4. Buyer claiming through Credit Card for non-receipt
5. System arrives
6. Buyer recieved, powers up, works.
7. Paypal drops original claim since I showed proof.
8. Credit card takes money from paypal
9. I get a chargeback.
10. I'm disputing it showing proof of delivery.
11. Seller agreement through Paypal not covering me because since it was over $250 item I needed a signature confirmation which I didnt put on there.
12.  Paypal also will freeze his account if he does not return the merchandise or take care of the chargeback.

This guy is a Amiga user, allegedly a Judge in New York City.  How can I forward all the emails between myself, Paypal and buyer to have him reported?  He is a member of AMUSE user group in New York.

Now, what am I guilty of?  
1. Shipping 8 days after payment recieved.  
2. Thought I shipped it in a new box but I didnt, box was crushed, A4000 made it and powers up, toaster works etc.


Do not be biased since I am a moderator on AO, I need pro and con replies.

In a few hrs, I'll post his name & address because I am not going to let a criminal get away with stealing a computer and not paying for it, and then scamming Paypal for it.

EDIT#2:If this makes AO look bad in any way I'm willing to step down from being a moderator on this site.  I strongly believe in taking this guy down.

Not to defend the other guy, but if you didn't send it out for over a week after receiving payment, the other guy really did probably figure he was being ripped off.  If I didn't know you (or even Redrumloa), if I bought something and the seller futzed around for 8 days, I'd be pissed too.

The two mistakes you  admit to are very major mistakes in my book, and considering all the horror stories here about ebay sellers ripping people off, I'm not quite sure I can say he was not justified by contesting it.

Now, since he's received the box, there are two choices as I see.

1) He returns it, you give him is money and work out something on post where both of you will probably lose something.

2) He keeps it and pays for it with your apologies for making these mistakes.

I dont mind either of the two options.  But from what it looks like he's keeping the A4000 for free.  If he's going to keep it, then he needs to pay for it.  And if he returns it, it needs to be in the same condition I sent it out being that he admitted it powered up and the toaster worked.  If it was damaged a claim could have been filed through USPS but since a claim was not filed, I assume it was not broken.

The fact that the package hasn't been sent for 8 days was a mistake (bad, bad seller!) ;-), however one should ask himself...what kind of a buyer requests a PayPal claim after only 8 days? Has he tried to contact you by e-mail during that time? No? An Amiga user that's a judge in NYC? More like a high school kid trying to pull an internet fraud, in my opinion (repeat, in my opinion...I'm only speculating on a hunch).

This looks like a fraud to me.

The mind of a kid fraudster ---> If I tell him that I'm a judge, he'll surely steer clear from this issue as he wouldn't want an angry judge on his back, would he now?

we kept in contact in email during the 8 days with me assuring that the package was sent.

What originally happened was I shipped it in 2 boxes.. one was the software, books etc..and then a big box w/the 4000, kb etc.

Box #1 (software books) arrived quickly..but since both were sent at the same time, why didnt the big box get there?  The tracking # was not showing up on the big box on USPS website.  I assured buyer I *did* send it that Friday along w/box #1.  But for a few days you could not see it as me sending it.  I could not explain it.  So that looked as if I didnt ship it which caused him to file.  Roughly, box #1 gets there on a Monday or Tuesday..box #2 that following Saturday.  All the time following up to Saturday the tracking # isnt updated on USPS which I do not have control of.

A buyer who -- like me -- has been bitten by {bleep}ty sellers a few times.  That's who.  I ordered a book from an Amazon seller with 1000+ sales and a 98% positive rating.  The very day that I sent the money, complaints started coming in about the seller screwing over another 760+ people sending his rating to about 19% positive.  Took me a month to get my money back.

In any event, once payment is made, it's entirely on the seller to get things done.  In this case -- and I hate to say this -- it doesn't look as though Alex followed through like he should have.  Even an e-mail to the guy saying "I'm an idiot and forgot to send it out today" would have gone a long way towards resolving any problems.

I *hate* that I'm sounding like I'm not on Alex' side on this one, but the 8 day delay is a major thing.

Ok.  That's cool.  I didn't realize that this was an issue with USPS outside of your control.  You had said that you didnt' send it for 8 days, which I took as being your own delay.

Are there not UPS time stamps (from the sending side) on the boxes, that prove that they were sent at the same time? Failing that, the tracking numbers should be sequential, shouldn't they? The guy can see that you sent them at the same time, surely...

no that is correct.  I didnt actually send it for 8 days.  I had other personal things going on of which I will not disclose and it took about 2 days to actually remove my personal (programming stuff) off of there.  None of this was told to the buyer.  The additional delay between both boxes was USPS fault.

So again, I am at fault for shipping late, yes, correct, 100%, I admit it.  

That is done and over with, item recieved.  Time to be a man and pay the bill or return the merchandise.


X-Ray:  No, because I ordered the label/shipping through my Paypal account.  USPS doesnt stamp it I dont think.  


Also Wayne, I'm not asking for bias.  I do not hold it against you.

The simple fact is that he has the merchandise, and you don't have the money.  There is no question that the buyer should pay for or return the merchandise.  

I don't see the point of the discussion.

It was a simple misunderstanding.  No big deal.  Alex is frustrated by the situation and wanted advice on how to resolve it.  At this point, you boiled it down nicely, but I believe several have already said the exact same thing.
