It can still be traced back to him, the isp stores all ip information, who`s had that ip that day etc etc

Yeah, I would give away CDs... they would be free as in speech... even PD authors allowed PD houses to charge above disk prices. And not forgueting, this is a bid, if people want to pay for a 0.30€ CD-R about 500€ they can!

Sorry, but you are incorrect. They most certainly are illegal.

"Abandonware" is a funny term. For some reason, some idiot got it in his head that if a company chooses to no longer distribute or support one of their products, it has been abandoned and anyone can copy it. What a bunch of crap! A company doesn't lose the rights to software just because it isn't sold or supported. This means that unless you get specific permission from the owner of said rights, you are indeed in violation of copyright law for distributing or illegitimately owning that software.

I should also like to point out that just because a piece of software is freeware or pd does NOT mean that said software doesn't/can't have restrictions to its use or distribution.

So.. What DoomMaster is doing is illegal.. I'm not an anti-piracy advocate, but anyone dumb enough to try to profit from it publicly (such as on ebay) deserves what misery may befall him.

Hmm.... I totally agree with mjg59 and madgun68.  Clearly this is profitting by a blatent disregard for copyright.  

Its a rare day that I manage to come down on the Anti-Piracy side of an argument, but this really scrapes the bottom of the barrel.  By SELLING those disks, you are violating the current ACTIVE licensing terms.  It's no better than selling copies of Norton Anti-Virus 2004.  Both have VALID, ACTIVE LICENSES limiting their distribution.  I'm saddened that anyone would be sick enough to buy these items.  (Then again, there is no end to the sickness in the Amiga community lately.)

Just because an item is free from one place, it does not mean you can repackage it and sell it elsewhere for a personal profit without permission.

The GPL actually allows you to sell software for any cost - however, if you provide binaries and not source, then you must be willing to provide the source for nothing other than media and copying costs (or provide an FTP site or something).
