Nope, 3.5 includes a time limited demo of Miami. The Genesis version included with 3.9 is unlicensed and thus illegal IIRC. Haage and Partner made a mess of that.

It sucked anyway.  Always crashed even after a fresh install.  Miami DX was well better.

3.5 isn't going to be any different. Neither is 3.1.

Genesis?  It's always worked great for me, though I'm using the one that comes with 3.9.

Yeah, Genesis has been rock solid always. I've been using it for 10 years on several Amiga setups (030, 060, Peg) with separate version and with OS3.9's version. Never caused any problems. I even had A1200 being web and ftp server 24/7 with it for years.
Daily MorphOS user and Amiga active.

I wouldn't go to 3.5. It's like half-assed version of 3.9 and should be forgotten forever. Go for 3.1 if you want earlier version.
