Because there is such a thing as an unregistered or "common law" trade mark whereby a person acquires rights in a name just by using it.


I say, AROS may have a case, and it might be fun to see where things go. :-)

Hi,

even if the name "Zune" is registered by the AROS team for the GUI, it is a registered name for a peace of software. The name is not registered for everything and so Microsoft could use the name for a peace of hardware.
If I like it I could open a company and name it Microsoft, if I have nothing to do with computers at all (maybe building "Microsoft Windows" and "Microsoft Doors" for your home :-D)

Zune isn't just a name for a piece of HW. From the Zune  Info site:

The Zune name has been confirmed and is now been officially used as an umbrella brand for what Microsoft says is “a family of hardware and software products” targeting various digital entertainment services, which should be out around November/Christmas time.

Not quiet correct, it's "Domino's Pizza" vs "Domino Sugar".  the "'s  Pizza" was the saving grace for DPI.  Corporate use to get really hyper if anyone answered the phone by just saying "Dominos".

There seems to be quite a few websites dedicated to this product.

I'm sure there were a cough sweet called Zunes before. I know there's Tunes but I am positive there was one called Zunes.

Eitherway, with the dominance of Microsoft so blatant nowadays we need to remember the statement...

"History is written by the victors"

In this sense it is a shame such quality products as Vista and Zune will be associated with Microsoft products, even if they are completely unrelated. However given the size of Microsoft and the once size of Amiga, it's only a matter of time before products start repeating the names of y'ore...

Well, there is a windows program named workbench, and there is a directory named MUI in windows.There is even a boingball in windowsXP.so, i´m very sorry but Microsoft has done it already  :-(  :-x  :madashell:  :pissed:
