Missuse of the Amiga.org Logo?
« on: March 28, 2006, 10:32:35 PM »
Is there a copyright on the Amiga.Org Logo?

Someone here in Switzerlanbd tries to sell 99x poster with frames.

URL shortened

The text is in German, but you can see the Logo at the right bottom edge

I'd say this is breaking the laws of copyright on a little more than just 1 occasion :-D

I try a translation:

This is a 99x multiple auction beginning with CHF 49.-- (~ $ 36.70) for a Poster in "Retro Style" including a frame (size 80 cm x 60 cm. The rest of the text only tells about the beautyful wonderfull time of the C64 area etc.

What is it with the sudden burst of people ripping off artwork from Amiga.org?

Why would anybody want to buy such an ugly poster anyway?

A stylish design would be the guru-meditation centered on a black background and no logo's whatsoever. OK, maybe just a tiny boingball to annoy Amiga.inc

This sucks, bigtime.

I have found yet another person mis-using the Amiga.org logo. :-x

This time it's here on youtube.

Just look at the logo just after UAE4ALL starts, hopefully something can be done to stop them.

@Lando,

This newest situation represents an interesting quandry as they are obviously -- at least in some way unlike eBay idiots -- supporting the Amiga platform.

As such, I have written GP2x.com requesting that they either remove the logo altogether, OR preferably, that they send us a complete GP2x system to review and evaluate for the users of Amiga.org.

In this particular case, while I hate the fact that they're using the logo illegally, I'd much rather trade a limited license for the use of that image in exchange for the chance to review this hardware for our members.  C'mon, let's face it, a walkabout handheld UAE is potentially a cool thing that I'm sure a LOT of you would like to actually own.  It is, in fact, what a lot of you have been screaming at Amiga Inc to create for years.

I almost hate to bring this up, but I don't think that a graphic made up of a capital A and three registered trademarks of other companies, including a checkmark, a red square and a boing ball, is legal grounds for copyright. The AO logo, at best, might qualify as a trade symbol, but combining logos clearly belonging to other companies, arranging them into one and calling them "mine" would, in all likelihood, never hold up under real legal scrutiny. It would be like me taking the CBS, NBC and ABC logos, putting them into a single graphic and saying "this is mine." It just isn't going to fly legally.

The AO logo itself is taking just as many shortcuts through copyright law as anyone who uses logos belonging to other trademark holders would be.
I sold my Amiga for a small fortune, but a part of my soul went with it.

If wayne has permission of amiga inc. to use the trademarks in this manner and to call it his own this is going to fly legally. Otherwise it would be like when a joint venture of CBS, NBC and ABC combining their logo´s would not be able to protect it.

You'd probably be better off dontacting the author of the program (his website is http://www.vividvillage.com/)

That's pretty cool. It would have been nice if they had done more than come to AO just to nick the logo.

To be fair to him, he might not have known it was the A.org logo. I just typed "amiga logo" into Google Image Search, and this was on the first page. It could be that he saw it and assumed that it was in the public domain.

I'm not saying it's right for him to just take it without checking copyright, but at least he's not trying to make money out of it.
