Netventures, CMS Derks and Amiga
« on: February 25, 2004, 03:50:28 AM »
Hi
According to their homepage, Amiga is one of Netventures subsidiary.
On their webpage, they mention a related law firm: CMS Derks Star Busman
Why Netventures or CMS Derks did not help defend Amiga IP on the case?

Netventures
CMS Derks

Probraly for the same reason that they pulled Garry Hare back out of AInc ....
1. Make an announcment.
2. Wait a while.
3. Check if it can actually be done.
4. Wait for someone else to do it.
5. Start working on it while giving out hillarious progress-reports.
6. Deny that you have ever announced it
7. Blame someone else

Probably because the law firm works for the investors, not the investees, but who knows, they may meet them yet. (throws veil over face while planting tongue in cheek)

I'm getting images of Ronald Regan with a towel over his head.

>Law firm works for Investor, not Investee

Hi
In my opinion, Amiga Inc is part of Netventures assets.
The main part of an IT company asset is its IP.
If CMS Derks defend Amiga Inc IP, they actually defend the asset of Netventures.
I don't understand why they don't help Amiga Inc.
Perhaps one of the reason: their lawyers do not have any experience with laws in the States.
If Genesi really get the AmigaDE trademark, perhaps Sharp, Nokia or even Microsoft can get the same trade mark, based on their agreement with Amiga Inc.
Perhaps they can force Amiga Inc to port AmigaDE to various new products.
On the court document (from merlancia.us), the judge did not mention trademark or upgrade.
Is there any other documents about the judgment?
Thx.

The court case was all about licensing the IP, something the investors want to see happen because it generates money they can collect.  Therefore AInc was on its own.  However, if Genesi starts making noises about voiding contracts and generally trying to take over trademarks, they might decide to step in.

Net ventures wrote off Amiga Inc. long ago. Email them.

And why would Net Ventures want to stop Amiga Inc. making money? Some people here forget that it is A Inc. that are causing all their own problems, it is laughable when you realise that Genesi were suing Amiga Inc. to be "allowed" to buy Amiga Inc's one and only product.
