I've been out of the loop for some time and I was just wondering if someone could tell me what the heck Hyperion and Amiga Inc. are feuding about. I did a little bit of digging on the net but didn't find any info. It just doesn't make any sense at all to me.

Amiga, Inc. chartered in Washington State mentioned being insolvent which would have made Hyperion the owners of AmigaOS.  Then KMOS chartered out of Delaware, bought out Amiga, Inc. Washington and renamed themselves Amiga, Inc.

When this took place they started claiming that Hyperion didn't own AmigaOS even though Amiga, Inc. Washington (now known as Amino) is still insolvent but hasn't filed insolvency papers.  Now Amiga, Inc. claims it wants to come out with AmigaOS 5.0 but Hyperion won't give Amiga, Inc. the source code because, thinking that Hyperion owned the code, had developed it far more than what Amino had originally negotiated for.

Now Amiga, Inc. Delaware and Hyperion-Entertainment, VOF are in court-appointed arbitration.

Yea, that about sums it up.
You did leave out that AminoOS5 is Amino anywhere2 though.

That's because, according to Amiga, Inc.'s website it isn't AmigaOS 5.

Yes, it appears that OS5 is an operating system built upon Taos Intent (Amiga Anywhere) but since KMOS (Amiga Inc) really only produces bollocks, I wouldn't take their website too seriously.

Also Amiga and AmigaDos really belong to Acer (which bought out Gateway) and Amino/KMOS only possess an exclusive license to it, the name Amiga and whatever IP hasn't fallen into public domain.

KMOS, the current Amiga Inc claims not to be any relation to Amino, the previous Amiga Inc and certainly not responsible for that big pile of unpaid bills and salaries that Amino has.  Barring Acer stepping in, Hyperion has the greater claim since their deal came before the KMOS deal, that is to say Amino transfered AmigaDos 4 to Hyperion before it transfered everything else to KMOS.    But did Acer (Gateway) have a say in the deals?

Now was the original plan to transfer everything to Hyperon, rename it and hijack it rather than KMOS?  This would actually make an interesting sort of video game story...
