The situation is: Ainc must win to get os4 into their hands.
Hyperion must not to lose, to continue his work.
Recently ainc not win, hyperion not lose, so now hyperion seems the winner.

Hopefully the last nail in the coffin for the Amiga.
ONce it's dead, we can finally revive it!

Now, where's that FPGA based, A500 compatible ATX motherboard? :-)
Beating the dead horse since 2002.

Getting my two cents in everywhere,

I am sorry but I do not see where Ainc has lost anything except the right to injunct Hyperion from selling OS4 to an Amigaone computer builder. The judge stated that the status quo remained. He could not see on the basis of Ainc's argument where they would be finacially harmed by leaving things the way they were and that the points which Ainc has brought to the injuction hearing are obvioulsy in dispute and that only a court case would be able to decide them. The court case will hinge on weather Hyperion can prove that Ainc Washington was insolvent and therefore must turn over the properties to Hyperion and Eyetech. And the judge stated that he did not see where that was proved in Hyperions response to the request for an injuction. The only thing I think is that this will take a lot longer and that is too bad for us.

That sums it up for me too (except for the last bit, as I think it doesn't make any difference there.). Amiga Inc haven't won, and Hyperion are far from being in the clear. Both companies have acted dishonourably from the start, and both have lots of shenanigans they want to keep hidden. In truth neither company deserves to be in business any more.

Its like watching two junkies fighting over an empty wallet.  Starts out entertaining, then after a while you just want to unload a cartridge into each one and put them out of their misery.
