Art Department Professional 2.5.1 is legally available from the TOSEC Amiga Collection hosted on archive.org.

Why would you assume that site holds "legal" distributions?

Why would you assume it doesn't?

I guess the question (in my situation anyway) would be if the update from 2.5.0 to 2.5.1 was, when released, a free update for legal owners of 2.5.0?  If it was then I believe there would be nothing illegal for me to update my purchased with serial copy of 2.5.0 to 2.5.1

Exactly.

This is why the Amiga is dead.

Lots of grumpy old men seeking for an excuse.

If an owner of a copyrighted work believes his work is being illegally distributed by a huge organisation such as archive.org then all it takes is one email to them to have it removed as is their legal right.

If it doesn't get removed then it's pay day for them in court. Wouldn't even need a lawyer.
