All you'd have to do is to show that the thing was invented years ago and that they didn't invent it and the patent would be struck down or something. The patent office probably only checks to see if something has already been patented and if someone invented it years ago but didn't patent it, then they wouldn't know about it. Just wait for the first case to happen and then it'll all fall apart.
