Not acceptable, sounds like the item was clearly misrepresented. Did you pay with Paypal? If so you should be able to get your money back through buyer protection.

That's a possibility, of course. However the problem is how many people are simply too affraid to speak up in fear of retaliation? This guy may continue to sell misleading items, with future buyers having no warnings. Besides, often it just takes a single user to leave negative feedback, and suddenly there will be a landslide of them against a seller. Others who may have been affraid to leave one, will suddenly jump on the bandwagon. I deal with about 10% fraud buyers and nonpayers for whatever reason. I go through all the motions, but in the end I will damn well leave negative feedback.

Also I just thought of something, did you file a FRAUD REPORT with eBay? This item was grossly misrepresented, that constitutes fraud.
