@TjLaZer

I'm not trying to ruin anyone's party, but do you have a permission to redistribute these roms?

Don't get me wrong, I would be more than happy to see the roms available for anyone needing them, but the copyright laws must be obeyed aswell.

Since you are so concerned will you contact RCS Management and ask if it is ok to offer their latest update to legitimate Fusion Forty cards?

I'm not the one offering the ROMs for download.

Quote
This update is required to make their card work with Kickstart 3.x. I am not selling the ROM just offering it to Fusion Forty owners.

All good, if you have the permission (a kind of a license).

Quote
I am pretty sure RCS Management is not around anymore, and it would be almost impossible to contact them.

This really is no excuse. If you can't get the permission you can't redistribute the copyrighted material.

Quote
Mattias Lundblad does seem to have a site and he offers to give you the ROMs when you contact him, but a few of us have and never got a reply. I will email him again asking if I can offer it online.

I doubt it will be a problem and I think you probably will get the permission. Until you do, I'd suggest you don't spread the files.

Regarding the Copyright. Lets see. To not violate potential copyright laws we should throw away our Fusion Forty cards instead of upgrading them from image files on the internet if we wish to use the latest Amiga Operating system. Nice! Would that make everyone happy?

Probably not.

Quote
The site http://amiga.resource.cx hosts all the RCS disks too, should we shut that site down too?

I hope they do have the permission to host the files they host.

www.amiga-hardware.com got into trouble just because single copyright holder asked the site to be taken down due to unauthorized downloads. That didn't many everyone happy either.

Just because single site has permission to have something available for download doesn't mean everyone else has the same right aswell. For example back2roots has (or had, the site is down for months already) explicit permission to have certain titles for download.

Quote
- Edit - due to whining of some people I removed the site, simply pmail me and I gladly give it to you, as I would like to help my fellow Amigans keep their Amigas up and running unlike some people!

I have no hidden agenda, nor I can stop you from hosting anything. I just asked you if you had the permission to host the files, since it might get you into trouble if you didn't.

I find it quite surprising you don't seem to be able to have adult discussion about this.

For those worried about the copyrights check out an article:
Pete Loshin, "Abandonware: Welcome to the Netherworld of Gaming Software Limbo" Computer Power User Magazine p 81 Vol. 6 issue 4, April 2006.

In this article, Mr. Loshin is speaking about old roms for MAME and MESS that publishers abandon. I will quote from the article, "Unlike free/open-source software, abandonware has no legal standing; it's a matter of economics that games publishers abandon their older games rather than maintain a backlist of titles like book publishers do. When a game's owner does assert copyright and request an old game be taken down (referring to any website), the gamers must comply."

I would definitely put Fusion 40 ROMs in the abandonware category.

There is no such thing as abadonware, at least not on amiga.org.

Do not post links or requests for warez.
Warez in our definition is illegal software up to and including "abandonware". The exception is if the person is KNOWN to have the legal right to distribute said software. This is not debatable.

From: Amiga.org posting guidelines

Again, let me reiterate: As long as there is permission to redistribute the ROMs I have no problem. I am not trying to make trouble.

Is it really that wrong to allow these users to get the latest ROM?

Of course not. This is not the point.

But if I am breaking the laws then it is reduculous and the laws need to be changed!

Unfortunately the copyright laws have just gotten stricter recently. :-( Consumers have less and less rights.

You still don't seem to understand that I agree on the moral ground. I certainly would love to see the ROM Images available for everyone who needs it.

But, until you have the permission, it's not legal to distribute them. To avoid amiga.org getting into trouble, you should IMHO not offer the files here (amiga.org could be held accountable).
