Amigakit or Vesalia most likely have it, but as A1260 says it's easy to find on trackers.  Softhut would likely have it as well, but it generally takes time to get a response out of them.

I had bought it years back and found the CD to be too scratched to be read recently and ended up grabbing a new copy off TPB.  Legal?  No, but I did pay for it once, and I needed it for the new Amikit box I recently threw together.  I won't lose sleep over grabbing a new copy of something I paid for once already, lol.

Agree, but there's also been a lot of reports of people buying a "legal" copy of 3.9 from "dealers" only to have it arrive on a CD-R with a sloppy B & W printout in the jewel case.

If I'm going to be a thieving scumbag, I'd prefer to do it by my own accord rather than fill the pockets of people masquerading as "keeping the Amiga alive!".

Make sure whoever you choose to support isn't just DL'ing off TPB and burning copies.  Paying people to be pirates is worse than being one yourself, IMO.

OS wise, it's fairly well priced (3.9).  As for how much you'll enjoy it over another WB version, I personally still prefer WB 3.1 and the various ClassicWB type packs are very nice.  If it's going on a UAE box, you don't have to worry about a networking stack.

Some people love 3.9, I sorta find it cluttered and gaudy, lol.  It's hard to go wrong with a well customized version of 3.1 in terms of reliability and usability.  3.9 has a lot of doo-dads to modernize it, which is a pro or con depending on your preferences.
