not positive to state what's been obvious for a decade, and to follow official Amiga, Inc. trademark guidelines as stated on their website ("Do not write 'the new Amiga'", etc.)?

I think the word you're looking for is not "controversy" in this case, but "redundancy".
If you mean the company "Amiga, Inc", I guess it wouldn't be too hard for many to justify writing an article about their death.
