Hyperion is not the one you should contact. They only have 3.1 rights to use and distribute, but no ownership.

If you plan on using 3.1 stuff modified + some of 3.9, you will have to contact both the defunct Amiga Inc, and Haage & Partner.

If you use your Amiga as a dumb gaming console, nothing.
If you want to push it to the extreme, you can have support for harddisk bigger than 4GB from rom. You can have a 3.9 kickstart without the need for the double reboot. You could get an overall faster and bugfixed system than 3.1. You could replace your con-handler with KingCon, so that every cli you use since boot can have all kinds of nice features such as name guessing, history, etc. If you have USB, you can boot from usb devices.
And many others that I miss.

So at the end it depends on what you expect your Amiga to do for you.

Let me put it for you in another way:

If you use your amiga exclusively for games, and dont give a damn about what kickstart or OS does it run, as long as you insert a floppy, turn the power on and then play, and that is about all you do with it. Then, if that is the case, this type of kickstart rom update is useless.

An Amiga is much more than a gaming console, dont you think so?
