Sampling within a specified amount of seconds *is* allowable under others' copyrighted work. See what people have released commercially under rap/hip-hop for decades.

Sure it's allowable, as long as you get permission.

Hmm... looks like it's mainly up in the air still. Some judges prohibit it, some throw the cases out. Looks like the RIAA even criticized a 3-note ruling. In any event and especially in these litigation happy times, best to always seek permission. Although I think the chances of anyone from these studios caring about some samples in a homebrew Amiga game are a million to one.
