On every other platform of the same vintage I don't think these issues would come up.. the only reason the Amiga is different is because there is so much money flowing around the hardware for these still - $40 for a rom chip is off the planet. The money isn't going anywhere useful - the current owners are just milking the rights.
Sometimes I wish the Amiga would become a 'dead' platform like all the rest, and that all the opportunists would move on.
So in short, I think it is just fine to copy kickstart roms. Just like I'm fine with downloading/running old games without owning the originals.
