Could Hyperion really sell and officially support OS 4.x for a hacked PS3?
In theory, they wouldn't have to. If they released an ISO that installs OS4 on the PS3, that used Sony's crippled OS support, "someone else" could release a freeware opensource Picasso96 driver that uses a hack to use the GPU (if one was found).
