Someone mailing a disk is probably going to be the easiest (only) way.  

As for the legality, well, AFAIK, the A1000 is clear to use any 1.x kickstart disk.  And the disk would be useless to anyone who didn't own an A1000, as you still wouldn't be able to use the kickstart without an Amiga.  (ie, a PC couldn't read the disk to extract the file for use in UAE, or whatever.)  I'd say you're in the clear to mail a copy of a kickstart disk.

Not so sure about that, though.  For example, the local Commodore authorized shop used to offer free workbench / kickstart disks to replace any damaged disk you brought in.  Of course, who's to say they weren't bending/breaking the rules to do that.

Anyhow, downloading isn't going to do this poor chap any good, because even if he DOES find a kickstart disk image (very rare, as opposed to the ROM images, which are everywhere), he'll have no way to write it back to a disk.  :-(
