According to U.S. trademark law, you have to defend your trademark or you lose it.

Since Amiga Inc has done nothing to defend its trademark in the past, it has effectively abandoned it.

A one time thing isn't good enough. Defending one's trademark has to be done continuously.

Not to mention the fact that they have, as far as I know, never taken any action with regards to AROS, even though they have had complete knowledge of it's existence since the beginning.
