Sharing NDK 3.9

Does any one know the legality issues in publicly
sharing the NDK 3.9 files? They were always free from
Amiga Inc. and  I can't find and specific restrictions
in the distribution files I have. (Other than the copyright
notices). A couple of people have told me recently that
email inquires about making NDK3.9 available on Amiga Inc.
again all go unanswered. You can still buy the dev kit CD's
that include the NDK, but is that necessary? There are a
couple of sites still hosting the NDK like Open AWEB.

The NDK package doesn't mention restrictions on redistributing. Only the copyright notice. Without knowing
the specifics of amiga's copyright I can only guess. Some copyrights allow for distribution, some don't. If anyone has a sample of one from a similar package I would like to see it. I've looked back at a couple of my older dev cd's and they are equally ambiguous.... copyright notice without details. Someone else said they are making it available on another web site untill Amiga Inc ask them to stop. I bet the won't bother though as long as they're not profiting (or hurting Amiga Inc's profits) by doing so.
