Which is exactly why I want to start a class action suit against Amiga, Inc, for the coupon scam. They stated the coupon was for AmigaOne/OS4.0 Early Bird Bundles. Eyetech's boards, in AI's own words, are not AmigaOnes, thereby Amiga Inc committed both theft and fraud, by taking people's money *YEARS* ago. ;-)
If you want to sue over the coupons, great, I've told people about that for years. But your off base on the Paragraph 22 issue and the AmigaOnes. Nowhere is Eyetech mentioned here, this is all about Acube and this comment in the press release (which is included as Exhibit I). In it they say the following:
"Within the framework of the partnership Acube will act as a worldwide distributer of Hyperion's Amiga OS 4.0 operating system for a range of PPC hardware platforms including AmigaOne(MicroA1, XE/SE) and classic Amiga."
So Acube is going to be distributer for OS 4.0 (which Hyperion doesnt have the right to make them), they are going to distribute OS 4.0 of AmigaOne (which by definition already have OS 4.0,, so either they are going to repackage it and make more money (not allowed) or Acube is going to freely distribute final CDs, which do you think is going to happen?), classic amigas (which they had the right to do until the license was cancelled) and other PPC hardware platforms (which we know means SAM and Moana) which they arent allowed to do. The issue is that only Teron boards sold by Eyetech which included a license for 4.0 (and so Amiga got a royalty on them) are AmigaOnes. I made the comment the other day, that with Acube working on processor boards for the Terons I was wondering if they had found a bunch of board sans processors and were doing this to sell a bunch of old Terons at new high prices, AI is afraid of this as well, thats all that this is about.
