Title: Amiga logo
Post by: Garrett on June 03, 2009, 03:13:53 PM
Are there any acknowledged Amiga logos that people could feel free to use on, for example, their websites without risk of getting sued?

Not really I'm afraid.  We have the kinda sorta nice cushion of having been here for 15 years.  Commodore was still around though pretty much closing when we got approval for the use of ours.

You might circumvent the problem by taking your own digital picture of your own Amiga computer equipment (close-up on logo area).  In the fine print you should state that it is an image of your computer and that the logo is the trademark of Amiga, Inc. -- or something like that.  I do believe that this is fair use because it's your own picture of your own computer, but I'm no attorney (fortunately).

I wouldn't worry about it honestly. There are thousands of sites out there using check marks, boing balls and Amiga text with the red square thing for the letter 'i'. If A Inc complains, and I doubt they will, about your hobby/ fan site then take it down. It's not like they're gonna drag you into court with a lawsuit without asking you to remove it first.

I was under the impression that the Boing ball was never an official commodore logo. Seems to me that one would be safe.

Anyone got a large, high resolution image, or maybe even a vector drawing of the amiga checkmark logo, with colours and everything? Is the checkmark/tick even registered as trademark anymore? I just always wanted one on a T-shirt, and inspired by djbase' avatar, I want the T-shirt to be kick2+ deep purple :)

Inkscape is your friend, if you have a linux box somewhere. It isn't bad at vectorizing images.

There's also talk about a vector version in the comments here: http://www.amiga.org/gallery/index.php?n=2168

Seriously, do not worry about it. Amiga fans have been using the logo on websites for ages. In the incredibly unlikely event Amiga Inc. notices/cares, they don't have the resources to go after anyone.

The boing ball (as used by Amiga, Inc., in both color and stippled black and white) is an active registered trademark in the US. The classic logos should all be fair game, but the "Amiga" trademark is still owned by Amiga, Inc. for use in personal computer products, forums (yes, forums are specified), etc.

from: http://tcattorney.typepad.com/ip/2007/05/lifetime_of_tra.html

Lifetime of Trademark Registrations

For a trademark registration to remain valid, an Affidavit of Use (Section 8 Affidavit) must be filed:

(1) between the fifth and sixth year following registration, and
(2) within the year before the end of every ten-year period after the date of registration.

The registrant may file the affidavit within a grace period of six months after the end of the sixth or tenth year, with payment of an additional fee. The registrant must also file a Section 9 renewal application within the year before the expiration date of a registration, or within a grace period of six months after the expiration date, with payment of an additional fee. Assuming that affidavit of use is timely filed, registrations granted PRIOR to November 16, 1989 have a 20-year term, and registrations granted on or after November 16, 1989 have a 10-year term. This is also true for the renewal periods; renewals granted PRIOR to November 16, 1989 have a 20-year term, and renewals granted on or after November 16, 1989 have a 10-year term.
