Where? I can't see anything like that on the page, or the site TOS (http://marketing.justia.com/tos.html). Or are you perhaps talking about PACER?

- Amiga Inc has sued Hyperion VOF for breach of contract, trademark infringement, trademark dilution, unfair competition, replevin and declaratory relief.
- Amiga Inc presets tons of exhibits and other material to back up their case. Some of the material is obviously wrong and contradictory. Regardless, the case looks pretty strong (but IANAL applies naturally).
- The next step is expected to be response from Hyperion VOF.

Either way, no matter who wins, they are not going to put the OS on affordable hardware such as a Mac, XBOX, or Wii...
...and I guess even PS3 though who knows why you'd want to do that with Sony's track record of using cheap, disposable components.
