All what is happening is that one side is saying, No you cannot, and the other side is saying, Yes we can.

I really thought Bill said that H&P have no license to ship Amithlon. But H&P is saying here they do. Was it not the idea that these kind of things would not happen anymore after the start of this month?

I'm quite sure that this statement has something to do with a certain lawsuit...
H&P has never been known for keeping their mouths shut before, so why have they done so until now?  ( NOTE: Not an insult, I've just allways had the expression that they aren't afraid to express their opinion )

It's old(-ish) news really, as the statement was released a while ago and there has been another ugly and pointless exchange of flames on the Amithlon mailing list.

H&P's position seems to be twofold:

(1) they dispute Bill McEwen's position regarding the licensing, and claim the product is "fully licensed"

(2) they claim Bernd Meyer did not have the right to terminate his contract with them and therefore it is still valid.

No details backing up either position have been made available.

The "1st September" thing seems a bit fuzzy, as Amiga Inc are not taking action against all those who are infringing their copyrights at the same time. It is unclear who Amiga Inc are targetting, or indeed if there has been any action at all.  It's quite clear that H&P are not a priority.

The statement doesn't add anything useful to the mix anyway. We all knew H&P thought the contract was still valid which is why they continued to sell AmigaOS XL. None of the issues raised regarding the distribution of this product or the disputed factors were addressed at all.

All it's done is kick off more hysterics on all sides.

I didn't post this here as a news item when it was released because I judged it unworthy of the "news" tag.

Yeap it's not news, and I'm allmost certain that both sides are
"just" bluffing with their "gone sue ur ass off" speeches.

6-20 months (*) after the AInc/H&P dispute began it's still just
words, but no action.
Either both are to stupid, to bancrupt, to fearfull of
the outcome or any given combination of those.

I've given up hope on it.

* McBill stated that the troubles began with the missing sales
reports on OS3.9.

Kronos, if legal action *is* being taken do you really think they are going to inform *you* or make this public or something? Do you?  :-o

I believe such issues are best settled or brought to justice behind closed doors.

IF legal actions had been taken they would have started long ago,
cause noone wins by waiting here (except he is bluffing).

AInc looses money, because noone can buy Berniethon.

H&P looses money, because alot of users are waiting for
matters to be resolved.

So for the last 6 months they were either to stupid, or
couldn't afford to sue (financial or due to weak legal standing).

Don't see why any this should be different from the situation

doesn't this also have a bit to do with the 'missing inventory' Bill hinted about at AmiWest?  He seemed to imply that someone, my guess is in Germany, took a large storehouse of Amiga inventory - the impression I got was that it was taken as some sort of 'collateral' and that it seemed he was hinting it was H&P who had it.  

Hopefully the OS 4.0 situation (a timely delivery in Nov.) will distract the rest of us enough as we hopefully clamor for new AmigaOnes with the OS that the legal proceedings can then finish up behind closed doors once and for all.

AFAIK it's about the "Amiga-Museum" Petro got as compensation
for work done while Escom was under bancrupsy.

Seems that it was never deleted from the inventory.

There are also other companies in Europe ...
(I look forward to see the result of that missing inventory, and hope that Amiga will get it back, so they can make the Amiga museum  :-D )

So thats one of the reasons because of the "AmigaOne Vs. Pegasos" fight, or what???

If Petro has the right on his side, then Amiga Inc. still have lots of money somewhere, but I hope they will get their Amigas

Whats that about ?
Known facts:
Petro did work during the bancrupsy period under the supervision
of the "Konkrursverwalter" (whats that in english ?) and I
don't think he did it for free. I also remember an interview
shortly after Gateway took over, where Petro mentioned that
he would own the only working Walker (was in the background of
one of the pics) and some other Amiga-memorabilia since that time.

McBill seems to think that the HW still belongs to the Amiga-
inventory he bought in 99/00.

But was has that todo with A1 vs Pegasos, and how do you come
to the conclusion that AInc has lots of money (or any at all  :-P = ?

What makes you or hnl_dk think that they have any ? An what has it todo
with the "Amiga-Museum" ? And yes I think last years (lack of) actions
by the Inc do speak a clear language. Doesn't mean they are out of cash
(I wouldn't rule that out), but they are clearly not rich either.

If Bill & co bought the Amiga IP and the old Amiga Machines, which they whanted to use in a museum, then they have lots of money (or all the good old Amiga machines, which I hope they will get) some place (I don't know if it's Gateway, Petro or ...) they need to get!!!

If it's Petro, then is the big question: Where is he working right now???

And is that not an European company???

Does that company have anything to do ... Pegasos ... ???

Amiga make no secret of the fact that lack of financial resources have
held back their plans.  $7 million for the Amiga branding, IP etc
made a huge dent in their bank balance.  The fact is though that they
are still here after nearly two years and things do seem to be moving
forward.

Petro now runs an employment agency designed at putting Indian people to work in Germany?  Priceless.  I'll bet he trades all the Amiga hardware he stole from the Amiga Inc warehouse for them...

The main idea of the company is to get Indian IT-specialists! But the website is only in German and English  :lol:

Thats what I call a German company ;-)

The next thing they are going to do is to post synchronize all the Indian specialists, that would be German  :lol:
