Title: Suddenly everyone's a lawyer
Post by: mikeymike on September 09, 2003, 12:35:02 PM
Could we keep the 'wild speculation posing as fact' down to a minimum please?

Things like "it doesn't matter if AI goes down, HP will get the Amiga name", while it sounds like a good idea at the moment, I'm pretty sure none of you know that for a fact (amongst many other speculations flying around at the moment).

If I remember correctly, the basic terms of the agreement among Amiga, Inc., Hyperion Entertainment, and Eyetech, Ltd. are such that if Amiga Inc. goes under, the other two have the right to carry the Amiga name on their products, namely, AmigaOS and the AmigaONE. Something tells me that these two companies don't like Genesi any more than Amiga, Inc. does—probably for most excellent reasons—and Genesi won't find it any easier to hijack the Amiga name from them than they have found it to do so from Amiga, Inc.

HP is making OS4, Eyetech is selling A1.

Gateway say who has the Amiga name if AI go bust don't they?  It is
just licenced to AI??

If HP and Eyetech cannot use the name Amiga so what they have a
product to sell.

Jump to future:
Headline reads Hyperion Entertainment and Eyetech, Ltd Present...
Hyperion OS
Jump back

Sounds OK to me!

AI goes bust?
So what?  Who cares, what do they have to do with anything apart from
a name?

I hope those TARR links stay active, as they tell the full story.  The TESS ones don't, hence the pasting - if you start from http://tess2.uspto.gov/bin/gate.exe?f=login&p_lang=english&p_d=trmk (http://tess2.uspto.gov/bin/gate.exe?f=login&p_lang=english&p_d=trmk), you should be able to do a 'simple' search for "Amiga," and find the relevant entries.

Sorry Billsey you are completely wrong as has been discussed here and on the bunny and at ANN.  When Amiga Inc files Chapter 7 (I dont think there is anyway that they will convince the judge to let them file Chapter 11) all contracts by Amiga Inc become Null & Void, that includes any contract they have with Eyetech & Hyperion on the use of the name etc.  If Amiga Inc actually owns the name it will be auctioned off to the highest bidder, if they are renting it, it will be returned to its rightful owner Gateway.
