Post by: hbarcellos on December 11, 2008, 04:57:38 PM
http://www.amiga.com/images/aw_os4_image_album/290.jpg

They admit it's existence even during the legal battle?

There are a lot of OS4 desktop screenshots floating around the Internet. Unless applegeeks.com has a problem with AInc. having a copy of this particular one on their site, whats the issue?

Issue should be the legal battle between amiga inc and Hyperion, right?

If you're talking about os4 then why would the deny it's existence? They asked hyperion to program it and there's no way to prove it doesn't exist since loads of people have it.

THere hasn't been an update to Amiga Inc's webpage since 01 February 2008.  Whatever is there simply is.  But as far as the court case, it's AMiga Inc's contention that OS 4 was contracted out to Hyperion and belongs to them, thereforee they are showing their own property on their website...

Yeah - I know - and it's Hyperions contention that they were insolvent (no - not according to US code - just insolvent) and so - according to the contract - the property rights to AmigaoS went to them.

That's roughly the reason why they are at court now.

The contract didn't define insolvent, it just used the word.  Hyperion contend Amiga Inc were insolvent according to any reasonable person's view. which is enough in a Civil case.  But if we go to what is the purpose of the clause, to protect both companies from the other's insolvency and liquidation, then it becomes fuzzy.  That's why the judge is likely to split the baby in two, giving something to each party.  Amiga Inc will, I expect, get the ability to distribute OS4 and quite possibly a royalty on Hyperion's sales.

If people wrote clear contracts lawyers would have nothing to do....
