So much fake Amiga titles for sale now :( And they sell for full price, lame stuff.
But he just says that many said it was only bundled with shareware programs, this was a alot of talk when it got released :)

that picture dont mean ote - it could just be a scan of the original lacquer front, on a CD label.

I'd like to hear his explanation of that.

My version of OS 3.9 looks exactly like that except with a full size jewel case but its definitely a copy not an original, furthermore I purchased this from a reputable dealer whom I will not name. I don't think an original press is available period so at least its still available.

I got one from that guy expecting it to be genuine. Is this legal!? If it's freeware then why ask so much for it?

Umm, that's not the way I understand it.
From the write-up:
It has received both criticism and praise; criticism for being a 'shareware/freeware' upgrade...
All he's saying is that a lot of people have criticized OS3.9 as being OS3.1 with a lot of shareware/freeware programs preinstalled on it. I've heard people say this too. They'll say, "Don't buy OS3.9 as everything "new" on OS3.9 can be downloaded from Aminet anyway.
I still think OS3.9 is worth the buy, though. I own a copy.

Actually he/she doesn't. It reads to me as the seller's paraphrasing the opinion of people that 3.9 was nothing more than a bunch of 'shareware/freeware' hacks.

I wrote to the seller and pointed out that OS3.9 is NOT shareware/freeware, and he replied that it is, because the webpage he quotes in the ad states that it is.
Very lame and stupid IMO. I don't know if the CD he is selling is a copy or legit, but he believes that OS3.9 is shareware/freeware, so there is nothing in his mind to stop him from copying it and selling the copies.

You can go and complain to amigakit.com which sells the update at 34.65 inside a plastic bag. I am sure that a firm as important as this one know all about breaches of copyright. Please do contact them and complain.

Oops. I must have missed that part. I guess he is sellig illegal copies. (And I HIGHLY doubt AmigaKit is selling copies as he states.)

And here is my response:
Look at what you yourself have already written and/or copied. 3.9 can be installed over 3.5, or 3.1 and according to what you wrote installed to a blank hard drive. Therefore it must contain the contents of OS3.1 and 3.5 which are copyrighted IP, or are you now saying that they are shareware/freeware too? OS3.9 is NOT shareware/freeware, but it does INCLUDE some shareware/freeware programs as part of its contents. AmigaKit is not copying and making their own 3.9 CDROMs to sell. It is illegal!
I doubt my response will change anything, this seller does not care that it is illegal to copy OS3.9 and sell it.

I hope Wayne files a complaint with eBay for using the AO logo.
On top of that, he says that there's 700 disks on one CD, 750 on the other... ummmmm, at there really 1450 Amiga games released PD? Or give him the benefit of the doubt and say that, on average, Amiga games came on two disks, that's still 725 games supposedly released PD... does that sound right??
I'm tempted to buy one of these sets just to report him to the current IP owners of non-PD games. Think Psygnosis: I'm sure Sony would be happy to put a slap-down.

The guy must not know what amigaOS is but selling it anyway.

Could be that someone reading (and writing) in this thread has reported that new auction for possible copyright infringement. I wonder who would do such a thing? :roll:
I am sure that if you looked long enough and hard enough (Fred Fish) you could find that number of PD games, but do you really want to play that many PD games? :-D

Does anyone know if AmigaKit is copying and selling OS3.9 just as this eBay pirate is claiming, or do they have a license from Amiga Inc. to copy and sell OS3.9 with AmigaKit labels on the CD and/or Emergency Floppy disk?
AmigaKit, please clear this up for us.

The text on the CD even says:
"All rights of the producer and of the owner of the recorded work reserved. Unorthorized copying, reproduction, hiring, lending, public performance and broardcasting of the recording prohibited".
And hes printing them off!

So at this point he's violated AO's trademark, libeled AmigaKit, and potentially violated the IP of numerous companies including Amiga.
Not a bad tally for a day's work.
