Title: help: what to do with a misleading ebaY purchase?

ok not exactly Amiga related but close enough!  I recently made a ebaY purchase (http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=5189900697) for my vintage collection.  It was for a Atari SC1435 monitor listed as *new*  I paid a good sum for it, as I have a mint in box Atari Mega STE (http://www.vintagecomputercafe.com/mycomputers/MegaSTE.jpg) computer I wanted to use with it.  Well the unit arrived today in very used condition!  Scratches all over and a *old* crack on case!  So this is NOT new!  I emailed the seller to protest.  Not sure what I can do.  I paid paypal.  Anything I can do?

Paypal has a few "safeguards" in place, so check their site
for more info.  If you used your credit card to fund the
paypal account, you might have recourse with the credit card
company as well to cancel payment.

File also a complaint at Ebay to get your money back !!! This is a case of fraud !!

Was it shipped insured?
I'm assuming that the picture in the auction is not what you recieved.

No the one is the pic is a different one that is *used* that I am now using with my 4160STE computer!  I wanted a NEW one for my mint Mega STE!  But it turns out the one I had is in better shape than the one I bought thinking it would be new!  I am getting more pissed off now that I think about it...

I think TjLazer means something like this : if you want to buy a "new" Amiga1200 like the ones at Vesalia (http://www.vesalia.de/?V02b0f1559534517795e5f575208514e01101f0954414752050140090a1e31115579633a223c6373744e03263f2a2a76610539676671236c6f66782a296c6c713e5c5a490756153070797) then you do expect a "new" one, maybe not really manufactured last month but still un-used and in its original box !! No scratches, no dents, and in a bright new colour and not yellowed !!

Thanks for the link.  I guess I should give the seller some time to respond to my concern before I jump and file a claim with Paypal.

the people at paypal and ebay are pretty good with this sort of crap.
i paid for an item from hong kong and it never arrived so paypal instantly refunded the money to my account.
which was nice

If you contact your seller and ask to return the item, they are obliged to refund you via Paypal once you have returned the item to them.

However, considering they lied in the first instance about the condition of the listing; they might be totally unscrupulous and not refund at all; in which case it is a matter for Ebay & Paypal to sort out for you.

You should in the first instance file an 'Item not received' dispute; as you go through this process it will give you the chance to select the option 'Item arrived, but not as described'.  This will send an Ebay email to the seller outlining your dispute.  It is up to them to respond and Ebay will email you when they do so.  Ebay do however always suggest to call your seller first; you can request a members full contact details from Ebay; I cannot quite remember the whereabouts it is on the site but if you use the links at the bottom of the home page, there is a 'safety centre' and if you use the search facility within this; you will be able to request the sellers details to be emailed to you.  Then you can call them and assertively (!) tell them you are not happy and want your money back! :-D

On reading the auction, there's one thing that I can predict the seller will say about your claim, if he's one of those evil meanie types. He'll say that he said that he never opened the box so he can't be responsible for what's inside. I'm not saying he will say that, just that I wouldn't be surprised if he tries that kind of thing.

No neither would I!!!!!!  Which is why its best to do a dispute via Ebay & Paypal; you have more chance of a refund that way.  

I have a problem at the mo where I have bought a game from someone on Ebay and I had to pay via cheque because last month I was up to my limit on my Paypal account.:oops:  Well, the guy concerned has cashed my cheque and yet reckons he has never received it from me!!!  And wants me to send another one - yeah, right, like I am going to do that!!

I know there is a lot of genuine people that use Ebay (myself included), but I am starting to wonder if it is really worth all the aggro.   :evil:

Tj: wait to see what the seller has to say.  Ebay will offer very little of a refund.  Its a set value..I think for $100 you'll get $25 back..its on ebay so you'll have to search for it.  But I would be very disappointed also if I read it said *never opened*, MIB etc...

I guess I've been had too. Recently I won an item which the description said

"1 amiga ram expansion board, this has just been removed out of a working Commodore Amiga 500. I think it is min 2 meg but not 100% sure it may possibly even be 4 meg or if extremely lucky 8 meg. It has a switch to turn off memory for compatability for some of the games that wont work under extended RAM. As I say it has just been pulled from a working Amiga 500 and with the switch on and off it booted up and ran rick dangerous 2 in either mode it was switched at. The free mem displayed on screen also was significant and is visibly shown on the amiga desktop when booted up in either mode. This fits in the underside trapdoor found on the Amiga and can only be inserted one way as the connector is offset to oneside."

which looks pretty similar to a regular 512k expansion :

I can't try it because I don't have an amiga 500 at the moment. But judging from the x256 chips there's no way this can be a 2mb + expansion.

also the shipping price was outrageous. I paid 9 uk pounds (thinking the shipping rates in uk was quite high). but :

countzero : ALWAYS ask shipping costs before the auction has ended !! That´s a result of all the experiences I have already had, and trust me, I HAVE bought a lot  :lol:

£9.00 is quite a lot actually!  If you want to know UK shipping rates you could check (if you have an idea of the weight of the item your going to buy) on the post office website, which I beleive is just www.postoffice.co.uk but if you search google you will find the address!  Then you only need to add a bit for packaging (for example, a jiffy bag that a DVD will fit into would be about 60p, cardboard boxes maybe between £1.00 and £3.00 depending upon the size,); a lot of people just recycle their packaging on Ebay anyway!  Obviously larger items such as steroes, laptops, Amigas etc you would expect to pay between £10-15

If your ever not sure contact the post office or someone in the UK who can tell you if your being ripped off or not!!! :-D

thanks sarah&effy, I sent him the link and I asked him to explain why I paid 9 pounds for the shipping (ah after years, I need the pound sign on my kybrd, unfortunately it's been replaced by €). he already left a positive feedback for me, but if he doesn't have a good excuse for the overcharge or return the difference, I'll definitely not leave a positive feedback.

I wouldn't be so pissed if the board was actually a 2mb or 8mb expansion though ...

Well after complaining to the seller, he appologised and refunded me $50 Canadian from the $153 Canadian I paid!!  I sent an email asking why the small refund?  Have not heard back in days.  What should I do now?

Well, I got 6.13 uk ps back from him/her after my complaint, so the it's fine by me now. I left him/her a positive feedback.
