Is this legal? It clearly lists "Includes Amiga Rom files and Workbench images."

Probably not.
I saw an auction on ebay uk last night actually, it was a buy-it-now for about 2 UKP, and it included all the ROMS from 1.3 - 3.1. Definitely NOT legal.

Sad though it sounds, I can't be bothered going on eBay's wild goose chases to find the appropriate link to report offences.
