I think the movie that more closely describes the Amiga situation is "Titanic". Except that in Titanic there were survivors and the ending had a lot more suspense.

So it's OSNews' fault Commodore USA doesn't know how to design/can't commission a professional-looking website? They need to grow the hell up. Kudos to Thom for calling them out on their legal bullshit.

Maybe since 1994 these really havent been actual lawsuits... Maybe they have just been class projects for law school students which would explain their periodicity.

Fort Lauderdale, eh?  Interesting.  I believe the "Phantom" game console guy was based in Fort Lauderdale.  Connection?  Beats me, just a random thought about shysters.

EDIT: Another thought comes to mind.  What, exactly, constitutes a "statement."  When what's-his-name from Commodore USA says, "Hyperion has not made any statements regarding our use of the IP," does he not count a comment clearly made on behalf of Hyperion as a "statement."  Or are all "statements" required to be in press releases, articles, or advertisements, etc?

I would guess that Hyperion needs to dispute the trademark.

From all the articales I have read on slashdot etc over the years, US law seems to indicate if you do not dispute and allow a third party to use your trademark or one which is similar to your trademark, then you pretty much lose the right to dispute the trademark in the future.

Of course, this is all supposition on my behalf not being a lawer or anything :P

I will admit that this Commodore USA thing is already confusing people I work with thinking their is a new 'Commodre Amiga' suddenly out of the blue. If that is not diluting the name, then I don't know what is.
