Commodore Gets Rights to Amiga, Hyperion Takes Legal Action (http://www.osnews.com/story/23753/Commodore_Gets_Rights_to_Amiga_Hyperion_Takes_Legal_Action)

Sigh... Looks like the same old s&!t over and over again... :(
-
enough of this crap over at AW:madashell:...honestly I'm tired of lawsuits and I like AROS and think any association with A Inc. is damaging their credibility:(
-
It's OK. This lawsuit in no way holds back Amiga progress IMO. The funniest thing I've read all week is the quote, "We are ecstatic to be partnering with Amiga Inc. ..."

I think it is more a shot across their bow to be honest, and rightly so!

With all the past history, a bow shot would be pointless.
If serious, it should be a full force frontal offence or go home. IMHO

Heh.... another chapter added to the seemingly endless and poorly written cheesy novel which is Amiga.

It's kinda like groundhog day. But with lawsuits.

"Our reply? We refer you to the reply given in the case of Arkell v. Pressdram."
Just brilliant!

Who can we sue? We gotta sue somebody! Amiga.org sues broccoli farmers because...?
-
Hah!
The first thing I noticed about the letter was the code section quoted: O.C.G.A., as in the Official Code of Georgia, Annotated. I noticed this because my full time job is in law enforcement in the state of Georgia, and I deal with various parts of the O.C.G.A. every week. I found this interesting because I had no idea Commodore USA was based in my state.
Well as it turns out, they aren't. They are based in Ft. Lauderdale, Florida according to what I've found on their website and via Google.
So my question is, how is it possible for a company based in Florida to try to use a Georgia law against a website based in neither state?

At least "Groundhog Day" had a plot that you could follow...
No need to make popcorn for this overly dramatic movie... I'll be sleeping.
I think the movie that more closely describes the Amiga situation is "Titanic". Except that in Titanic there were survivors and the ending had a lot more suspense.

Good, we need some new lawsuits....it was getting a bit boring around here without them.

I know, when I grow I'm gonna be a lawsuit! Really what did you all expect? It was like the perfect storm forming in front of your face.
No one owns 'Amiga', uh I see that as a little problem.

So it's OSNews' fault Commodore USA doesn't know how to design/can't commission a professional-looking website? They need to grow the hell up. Kudos to Thom for calling them out on their legal bullshit.

Amiga, Hyperion, et al should setup Lawsuits R Us.

Good, we need some new lawsuits....it was getting a bit boring around here without them.
Maybe since 1994 these really havent been actual lawsuits... Maybe they have just been class projects for law school students which would explain their periodicity.

Fort Lauderdale, eh? Interesting. I believe the "Phantom" game console guy was based in Fort Lauderdale. Connection? Beats me, just a random thought about shysters.
EDIT: Another thought comes to mind. What, exactly, constitutes a "statement." When what's-his-name from Commodore USA says, "Hyperion has not made any statements regarding our use of the IP," does he not count a comment clearly made on behalf of Hyperion as a "statement." Or are all "statements" required to be in press releases, articles, or advertisements, etc?
-
At least they are keeping us entertained...
-
I would guess that Hyperion needs to dispute the trademark.
From all the articales I have read on slashdot etc over the years, US law seems to indicate if you do not dispute and allow a third party to use your trademark or one which is similar to your trademark, then you pretty much lose the right to dispute the trademark in the future.
Of course, this is all supposition on my behalf not being a lawer or anything :P
I will admit that this Commodore USA thing is already confusing people I work with thinking their is a new 'Commodre Amiga' suddenly out of the blue. If that is not diluting the name, then I don't know what is.
